Accidents

Have you had a Road Traffic Accident?

This is the most common type of accident claim. Any accident that occurs in a public place involving a motor vehicle or bike. If you are injured then you are entitled to file a claim against the person responsible for the accident. Negligence must be established in order to succeed. The claim will be filed first with the Injuries Board and in most cases will be settled there within about one year.

If the Injuries Board are unable to deal with your claim, you may then proceed to file it in court.

If you were a passenger in a car or van, then you may have to file the claim against the owner of the car in which you were travelling as well as the third party motorist involved in the accident.

If a child is injured in an accident then the claim is filed in the name of his or her parent against the responsible party.

Damages recovered may include pain and suffering to date, pain and suffering into the future, medical bills, loss of earnings, special care required at home, home adaptations to help you cope with your injury, medical aids and equipment, chemists bills, travelling expenses.

It is important to get details of the other motorist including name, address, insurance company and policy number. Photographs of the scene of the accident are very useful if there is a dispute over liability for the accident. Photographs of car damage can also be very useful in court.

Have You Had a Workplace Accident?

The workplace can be a very dangerous environment. During the course of your employment your employer has a legal obligation to reduce the risk of you suffering an injury. However, many employers, in an effort to save on costs, do little to protect their employees against harm. A large number of injuries occur in the workplace every year many of which could have been avoided. These accidents can occur in offices, shops, factories, warehouses, construction sites or while operating machines or equipment in any working environment.

Some employees are reluctant to claim against their employer for fear of losing their jobs or being victimised. It is unlawful for an employer to dismiss an employee who files a claim and in reality this rarely happens as most employers have insurance to cover compensation claims against them and they hand over the handling of the claim to their insurers...

Your employer should maintain Health and Safety standards to ensure you have the best available protection against the risk of workplace accident. Your employer should also provide a safe system of work and adequate training and proper supervision in order that all employees may carry out their duties and use equipment safely.

If you have suffered an injury as a result of the fault of your employer or a fellow employee, we can help you.

A claim for an injury at work could include compensation for:

  • Loss of earnings;
  • Pain and suffering into the future;
  • Special care required at home;
  • Chemists bills;
  • Travelling expenses.
  • Pain and suffering to date;
  • Medical bills;
  • Home adaptations to help you cope with your injury;
  • Medical aids and equipment;

What is a Public Liability Claim?

The owners and occupiers of buildings such as shops, swimming pools, car parks gyms, bars, restaurants and other areas open to the public have a legal obligation to ensure they are maintained in a safe condition to prevent injuries to members of the public. The same rules apply to public roads, footpaths, schools and parks. These owners have a duty of care towards you. If you suffer personal injury as a result of such an accident you may be entitled to compensation. We will file a claim on your behalf before the Injuries Board and in most cases an assessment of your claim will be made within a year.

If your accident was the fault of the owner then you will have a claim for compensation for your injury and all your losses. If you would like to know if you have a claim we would be happy to give you an opinion and advice on what to do next with no obligation. You may contact us by email, telephone and text.

Steps should be taken to protect members of the public using these amenities. Holes in the road or in pavements should be filled in. Wet surfaces should be cordoned off and warning signs erected. Shelves on shop floors should be safe. Floor surfaces should be slip resistant. Carpets should be firmly fixed to the floor. Hand rails should be securely fixed to the wall. Buildings should be maintained. Paving stones should be level and should not present a hazard.

Have You Had a Sports Injury?

Injuries occur in sport all the time and most are not compensatable as they are not caused intentionally or negligently. In order to recover compensation, the injured party has to show that the other participant was negligent. The threshold for such liability in practice is high when it comes to sport. A participant will not be held liable for a simple error of judgment or instinctive reaction, even though the consequences might be tragic, especially in a fast moving game. Something more than that is required. At the very least there has to have been a breach of the rules of the game. However, that alone would not necessarily be sufficient to establish liability, especially if the actions of the participant were being conducted in a manner which was generally acceptable. The injured party does not have to prove that the other participant was "reckless", as such. Rather that he acted unreasonably in the particular circumstances and out of all proportion to the occasion.

Have You Had a Bus Accident?

Both passengers and drivers frequently sustain injuries while travelling on Buses. Many occur when passengers are disembarking and the driver slams on the brakes for no apparent reason causing the passengers to be pitched forward and injured. Buses have been involved with crashes with other vehicles on the road. A Bus may be driven negligently such that it is caused to veer off road or crash into something. Sometimes, because of some problem with the bus itself, such as faulty brakes, an accident may occur. We have successfully pursued many claims for injured passengers and drivers and have a team of experts available to inspect accident scenes and determine who is at fault.

Damages recovered may include pain and suffering to date, pain and suffering into the future, medical bills, loss of earnings, special care required at home, home adaptations to help you cope with your injury, medical aids and equipment, chemists bills, travelling expenses.
